maggior parte dei processi REACH, CLP e BIOCIDI \u00e8 necessario includere nei dossier le seguenti informazioni per identificare chiaramente la sostanza:<\/p>\n<ul>\n<li>Nome della sostanza e identificativi correlati (nome IUPAC, n\u00b0 EINECS o ECLINS e n\u00b0 CAS).<\/li>\n<li>Formule molecolari e strutturali.<\/li>\n<li>Informazioni sulla composizione e sulla purezza della sostanza.<\/li>\n<li>Dati spettrali e altre informazioni analitiche per verificare l\u2019identit\u00e0 e la composizione della sostanza.<\/li>\n<\/ul>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1525932988317-517ad062-c849\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1525932988317-517ad062-c849\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">Tutte le sostanze chimiche sono soggette agli obblighi di registrazione Reach?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>Il Reach si applica a tutte le sostanze chimiche, in quanto tali o facenti parte di un preparato o di un articolo, fabbricate, importate o utilizzate nella Comunit\u00e0 Europea in quantit\u00e0 superiore ad 1 tonnellata annua.<\/p>\n<p><em><strong>Esclusioni:<\/strong><\/em><\/p>\n<p>Il Reach non si applica:<\/p>\n<ul>\n<li>Alle sostanze radioattive.<\/li>\n<li>Alle sostanze soggette a controllo doganale purch\u00e9 non siano sottoposte ad alcun trattamento o ad alcuna trasformazione, e che siano in deposito temporaneo o in zona franca o in deposito franco in vista di una riesportazione, oppure in transito.<\/li>\n<li>Alle sostanze intermedie non isolate.<\/li>\n<li>Ai rifiuti.<\/li>\n<li>Al trasporto per ferrovia, su strada, per via navigabile interna, marittimo o aereo di sostanze pericolose in quanto tali e in quanto componenti di preparati.<\/li>\n<\/ul>\n<p><u>Sostanze considerate registrate:<\/u><\/p>\n<p>Per tutti (ma solo per il quantitativo destinato a quell\u2019uso)<\/p>\n<ul>\n<li>Sostanze utilizzate nei prodotti fitosanitari<\/li>\n<li>Sostanze utilizzate in prodotti biocidi<\/li>\n<\/ul>\n<p>Solo per particolari aziende che hanno notificato delle sostanze secondo la Direttiva 67\/548\/CEE (che possono tuttavia necessitare di informazioni aggiuntive se per esempio si passa ad una fascia di tonnellaggio superiore).<\/p>\n<p><strong><em>\u00a0Esenzioni:<\/em><\/strong><\/p>\n<p>Esenzione dall\u2019obbligo di registrazione (Titolo II):<\/p>\n<ul>\n<li>Medicinali per uso umano o veterinario<\/li>\n<li>Sostanze utilizzate in alimenti o in alimenti per animali anche se utilizzati come additivi o sostanze aromatizzanti<\/li>\n<li>Le sostanze elencate nell\u2019allegato IV in quanto presentano un rischio minimo<\/li>\n<li>Le sostanze elencate nell\u2019allegato V<\/li>\n<li>Le sostanze re-importate all\u2019interno della Comunit\u00e0 europea senza aver subito variazioni a condizione che ci\u00f2 venga dimostrato e che siano state fornite le informazioni tramite la scheda dati di sicurezza<\/li>\n<li>Le sostanze recuperate a condizione che non siano intervenute variazioni.<\/li>\n<li>Polimeri.<\/li>\n<\/ul>\n<p>Esenzione dal titolo IV (informazioni all\u2019interno della catena di approvvigionamento) ovvero scheda dati di sicurezza o informazioni sulla sicurezza chimica per i preparati allo stato finito, destinati all\u2019utilizzatore finale:<\/p>\n<ul>\n<li>Medicinali per uso umano o veterinario.<\/li>\n<li>Prodotti cosmetici.<\/li>\n<li>Dispositivi e alimenti per animali, anche se utilizzati:\n<ul>\n<li>come additivi in prodotti alimentari;<\/li>\n<li>come sostanze aromatizzanti in prodotti alimentari;<\/li>\n<li>come additivi negli alimenti per animali;<\/li>\n<li>nell&#8217;alimentazione degli animali.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1599818507206-303aa596-2d4d\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1599818507206-303aa596-2d4d\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">I polimeri sono esclusi dal Reach?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>Ai sensi del Regolamento Reach \u00e8 definito un polimero se sono soddisfatte le seguenti condizioni:<\/p>\n<ul>\n<li>Presenza di almeno 3 unit\u00e0 monomeriche<\/li>\n<li>Pi\u00f9 del 50% \u00e8 rappresentato da molecole polimeriche<\/li>\n<li>Nessuna molecola rappresenta pi\u00f9 del 50% del peso<\/li>\n<\/ul>\n<p>I polimeri sono esenti dalla registrazione Reach ma non dall&#8217;autorizzazione e dlla notifica della classificazione ed etichettatura se risulano rispondere ai criteri del Regolamento CLP.<\/p>\n<p>Tuttavia le unit\u00e0 monomeriche dovranno essere registrate se sono soddisfatte le seguenti due condizioni:<\/p>\n<ul>\n<li>Il polimero contiene pi\u00f9 del 2% di una unit\u00e0 monomerica o altre sostanze<\/li>\n<li>La quantit\u00e0 totale di una unit\u00e0 monomerica supera la tonnellata annua<\/li>\n<\/ul>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1525933131215-fe810ce0-7b7a\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1525933131215-fe810ce0-7b7a\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">Cosa sono le sostanze SVHC e quali fanno parte della Candidate List?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>Le sostanze SVHC &#8211; <em>Substances of Very High Concern<\/em> &#8211; sono sostanze individuate dal Regolamento Reach (art.57) come sostanze estremamente preoccupanti. Le sostanze possono essere identificate come SVHC se sono riconosciute le seguenti propriet\u00e0:<\/p>\n<ul>\n<li>Sostanze che soddisfano i criteri di classificazione come cancerogene, mutagene o tossiche per la riproduzione (CMR) di categoria 1A o 1B.<\/li>\n<li>Sostanze che sono persistenti, bioaccumulabili e tossiche (PBT), o molto persistenti e molto bioaccumulabili (vPvB).<\/li>\n<li>Distruttori endocrini.<\/li>\n<\/ul>\n<p>Quando uno Stato membro o ECHA, su richiesta della commissione, propone una sostanza come SVHC, questa viene inclusa nell&#8217;elenco delle sostanze candidate all&#8217;autorizzazione Reach, la <a href=\"https:\/\/echa.europa.eu\/it\/candidate-list-table\" target=\"_blank\" rel=\"noopener noreferrer\">Candidate List.<\/a><\/p>\n<p>Quando una sostanza SVHC \u00e8 inclusa nella Candidate List scattano alcuni obblighi giuridici per le aziende che fabbricano, importano o utilizzano queste sostanze nell&#8217;UE.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1603880448388-3a09c649-6a6d\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1603880448388-3a09c649-6a6d\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">Cos'\u00e8 il Database SCIP e chi riguarda?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>Nell\u2019ambito dell\u2019attuazione del Piano d\u2019Azione dell\u2019Unione Europea per l\u2019economia circolare, la Direttiva Quadro sui Rifiuti (WFD), direttiva UE \u00a02018\/854, ha conferito a ECHA il compito di sviluppare un database con le informazioni sugli articoli contenenti sostanze estremamente preoccupanti (SVHC) incluse nell\u2019elenco delle sostanze della <em>Candidate List<\/em>.<\/p>\n<p>Tale database \u00e8 stato denominato SCIP, acronimo di <em>Substances of Concernc In Products.<\/em><\/p>\n<p><strong>Obiettivi:<\/strong><\/p>\n<ul>\n<li>Ridurre la produzione di rifiuti contenenti sostanze pericolose sostenendo la sostituzione delle sostanze preoccupanti negli articoli immessi sul mercato dell\u2019UE.<\/li>\n<li>Mettere a disposizione le informazioni per migliorare ulteriormente le operazioni di trattamento dei rifiuti.<\/li>\n<li>Consentire alle autorit\u00e0 di monitorare l\u2019uso di sostanze preoccupanti negli articoli e avviare azioni adeguate durante l\u2019intero ciclo di vita degli articoli, anche nella fase di smaltimento.<\/li>\n<\/ul>\n<p><em><strong>Obblighi:<\/strong><\/em><\/p>\n<p>A partire dal 5 Gennaio 2021, tutte le aziende che forniscono articoli in quanto tali o in oggetti complessi (prodotti), contenenti sostanze estremamente preoccupanti (SVHC) incluse nell&#8217;elenco delle sostanze della <em>Candidate List<\/em> in una concentrazione superiore allo 0,1% in peso, sul mercato dell&#8217;Unione Europea, dovranno presentare informazioni su questi articoli a ECHA tramite tale nuovo database SCIP.<\/p>\n<p>Il database SCIP garantisce che le informazioni siano disponibili durante l&#8217;intero ciclo di vita dei prodotti e dei materiali, anche nella fase dei rifiuti, e verranno quindi messe a disposizione degli operatori dei rifiuti e dei consumatori.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1592297673922-850809cc-dd00\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1592297673922-850809cc-dd00\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">Cos\u2019\u00e8 REACH-IT?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>REACH-IT \u00e8 il sistema informatico centrale a disposizione dell&#8217;industria, delle autorit\u00e0 competenti degli Stati membri e dell&#8217;Agenzia Europea per le sostanze chimiche, per presentare e gestire i dati e i fascicoli in modo sicuro. Ciascuno di questi tre soggetti ha accesso a funzioni specifiche di REACH-IT utili per adempiere agli obblighi previsti dai regolamenti. REACH-IT fornisce inoltre un canale di comunicazione sicuro tra le suddette parti per aiutarle a coordinare il trattamento e la valutazione dei dati e dei fascicoli.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1592297691221-5851ef11-11cc\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1592297691221-5851ef11-11cc\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">Quali sono gli obblighi in materia di classificazione ed etichettatura dei prodotti chimici?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>Il regolamento CLP impone ai fabbricanti, agli importatori e agli utilizzatori a valle di sostanze o di miscele, di classificare, etichettare e imballare le sostanze chimiche pericolose in modo adeguato prima dell\u2019immissione sul mercato. Una volta classificata una sostanza o una miscela, i pericoli identificati devono essere comunicati ad altri attori della catena d\u2019approvvigionamento, inclusi i consumatori.<\/p>\n<p>L\u2019obbligo di notifica previsto dal regolamento CLP\u00a0impone ai fabbricanti e agli importatori di trasmettere le informazioni relative alla classificazione e all\u2019etichettatura delle sostanze che immettono sul mercato all\u2019inventario C&amp;L tenuto dall\u2019ECHA.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1592297721266-6e6d39d5-4ccb\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1592297721266-6e6d39d5-4ccb\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">Come ci si deve comportare con i biocidi?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>Tutti i biocidi necessitano di un&#8217;autorizzazione prima di poter essere immessi sul mercato; inoltre, i principi attivi in essi contenuti devono essere stati precedentemente approvati.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1592297758370-273faa8a-1e05\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1592297758370-273faa8a-1e05\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">Cos\u2019\u00e8 la Lettera di Accesso (LoA) nel Regolamento REACH?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>Nel caso di pi\u00f9 registranti per la stessa sostanza (rispondente agli stessi <em>criteri di sameness)<\/em>, il Reach prevede una trasmissione comune dei dati dove un dichiarante capo-fila (Lead Registrant) provvede alla presentazione del dossier completo (studi, sommari e CSR) per conto anche di tutti gli altri registranti; ciascun registrante successivo (Member registrant) trasmetter\u00e0 poi separatamente i dati individuali di registrazione (produzione, quantitativi, siti produttivi, eventuali usi non considerati nel main dossier\u2026) potendo fare riferimento, per tutto il resto, al dossier principale. Sar\u00e0 poi ECHA stessa che comunicher\u00e0 al potenziale registrante che avr\u00e0 presentato un dossier di inquiry su una data sostanza, se esistano altri registranti o potenziali registranti e i rispettivi contatti.<\/p>\n<p>L\u2019accesso ai dati pu\u00f2 avvenire con due modalit\u00e0:<\/p>\n<ul>\n<li>Entrando a far parte del Consorzio (qualora lo stesso sia ancora aperto a nuovi membri) e quindi acquisendo la propriet\u00e0 dei dati elaborati e degli studi eseguiti.<\/li>\n<li>Acquistando la cosiddetta \u201cLettera di Accesso\u201d grazie alla quale si acquisisce il diritto a far riferimento al dossier principale per la propria registrazione ma senza avere la propriet\u00e0 dei dati.<\/li>\n<\/ul>\n<p>In entrambe i casi il pagamento deve essere calcolato sui dati necessari in funzione della fascia di tonnellaggio per cui si richiede la registrazione. Solo dopo il saldo della propria quota, il potenziale registrante ricever\u00e0 il \u201ctoken\u201d per poter attivare la propria membership alla registrazione congiunta.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1601282872561-4574fa05-7009\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1601282872561-4574fa05-7009\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">Come sono regolamentate le importazioni delle sostanze chimiche in Corea?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>In Corea del Sud le sostanze chimiche sono regolamentate dalla Korean Chemical Control Act (CCA). Ai sensi dell&#8217;articolo 9 del CCA chiunque intenda fabbricare o importare un prodotto chimico deve confermare se la sostanza \u00e8 regolamentata presentando una conferma scritta dei dettagli per ogni prodotto chimico al KCMA (Korea Chemicals Management Association) prima della produzione o dell&#8217;importazione.<\/p>\n<p>La conferma scritta pu\u00f2 essere una Lettera di Conferma (LOC) che fornisce i dettagli delle sostanze chimiche, in particolare \u00e8 necessario specificare se la sostanza \u00e8 regolamentata, cio\u00e8 se \u00e8 inserita in uno dei seguenti elenchi:<br \/>\n\u2022 Sostanze soggette a un regime transitorio per la registrazione (sostanze PEC richieste per la registrazione con KREACH)<br \/>\n\u2022 Sostanze non soggette a un regime transitorio (nuove sostanze chimiche richieste per la registrazione in KREACH)<br \/>\n\u2022 Sostanze tossiche<br \/>\n\u2022 Sostanze soggette ad autorizzazione<br \/>\n\u2022 Sostanze soggette a restrizioni<br \/>\n\u2022 Sostanze vietate<br \/>\n\u2022 Prodotti chimici per la prevenzione degli incidenti<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><div class=\"vc_tta-panel\" id=\"1601283118793-fad5854a-cefe\" data-vc-content=\".vc_tta-panel-body\"><div class=\"vc_tta-panel-heading\"><h4 class=\"vc_tta-panel-title vc_tta-controls-icon-position-right\"><a href=\"#1601283118793-fad5854a-cefe\" data-vc-accordion data-vc-container=\".vc_tta-container\"><span class=\"vc_tta-title-text\">Cosa prevede il Reach Turco e cosa deve fare un'azienda per essere conferme alle normative in vigore?<\/span><i class=\"vc_tta-controls-icon vc_tta-controls-icon-chevron\"><\/i><\/a><\/h4><\/div><div class=\"vc_tta-panel-body\">\n\t<div class=\"wpb_text_column wpb_content_element \" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p>Il Reach Turco prevede la pre-registrazione e poi la registrazione di tutte le sostanze chimiche, sia in quanto tali che se contenute in miscele, prodotte o immesse sul mercato turco per un volume annuo &gt; 1 tonnellata. Per quanto riguarda invece le sostanze chimiche classificate pericolose, queste dovranno essere notificate indipendentemente dalla quantit\u00e0.<br \/>\nSe superiori alla tonnellata e pericolose le sostanze chimiche saranno quindi soggette sia a registrazione che a notifica<\/p>\n<p>Per quanto riguarda poi le SDS, in accordo al Regolamento SEA (allineato con il CLP europeo), queste devono essere preparate da una persona che abbia conseguito la certificazione come esperto preparatore in SDS in accordo agli standard turchi.
